Michigan Earned Sick Time Act Rules


Michigan employers are required to provide paid sick leave to employees. Some key compliance requirements that employers should be aware of include:

  • All employers that have one or more employee(s), including any person, firm, business, educational institutions, corporations, limited liability company, and government entities (excluding the US Government) in Michigan are covered by the ESTA and its requirements.
  • Employees must be able to accrue one hour of paid sick leave for every 30 hours worked.
  • Employees cannot be required to search for or secure a replacement worker as a condition for using earned sick leave.
  • Employees must receive their normal rate of pay for any paid leave time under this law, or the applicable minimum wage rate, whichever is greater.
  • Employers may restrict use of leave to specific reasons outlined by the ETSA.

Employers can automatically calculate and track paid time off based on an employer’s specific rules and policies. This ensures Michigan employers are able to configure the ESTA-required accrual rate of one hour of leave for every 30 hours worked.
